Terms of Service
Effective date: September 2, 2026
These Terms of Service govern your access to and use of ImagesArt.ai, located at https://imagesart.ai. By accessing or using the service, you agree to these terms. If you do not agree, do not use the service.
Who we are
ImagesArt.ai is operated by Bian Xuebin, an individual sole proprietor, located at 16th Floor, Shengjian Building, Jianye District, Nanjing, Jiangsu Province 210000, China ("ImagesArt.ai", "we", "us"). You can reach us at support@imagesart.ai or through the support channel provided in the service.
Eligibility
You must be at least 13 years old (or 16 in the EEA and UK, where a higher age applies), be able to form a binding contract, and comply with all applicable laws. If you use the service on behalf of an organization, you represent that you have authority to bind that organization.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date. Account credentials are personal to you and may not be shared, sold, or transferred. Notify us at support@imagesart.ai immediately if you believe your account has been compromised.
The service
ImagesArt.ai is a digital software-as-a-service product for AI image generation, image editing, image description, and prompt extraction. Access is delivered immediately once your account is credited following a successful payment — there is no physical product and no shipment.
The service is powered by third-party AI models. We do not train or host our own foundation models; every generation request is routed to a third-party model through an aggregator platform. Your use of the service is therefore also subject to the terms and safety policies of those model providers and platforms, who may independently refuse a request.

The models available in the product, and how we access each of them, are:
Image generation and editing

Image description and image-to-prompt
- Gemini 2.5 Flash, developed by Google. Model identifier:
google/gemini-2.5-flash. Accessed through OpenRouter.
We access each of the above under the terms of the platform it is accessed through, and we do not host model weights ourselves or redistribute them. This list reflects the models in use as of the effective date above and is updated when we add or retire a model.
Acceptable use
You agree not to use ImagesArt.ai to create, upload, generate, request, store, distribute, or otherwise process any of the following:
- NSFW, pornographic, sexually explicit, or sexually suggestive content, including nudity, sexual acts, or content intended to cause sexual arousal.
- Child sexual abuse material (CSAM) or any content that sexualizes, exploits, or endangers a minor, real or synthetic. Zero tolerance: immediate termination and, where the law requires it, referral to the authorities.
- Non-consensual intimate imagery, including "deepfake" nudes or sexual content depicting any real person without their explicit consent.
- Deepfakes and impersonation of real people — realistic synthetic depictions, face swaps, synthetic endorsements, and fabricated statements involving an identifiable real person, brand, or organization without documented consent.
- Graphic violence, gore, self-harm, or animal cruelty, and content that glorifies, promotes, or incites violence, terrorism, or mass harm.
- Hate speech — content that attacks, dehumanizes, harasses, or promotes discrimination against a person or group based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic, including hate symbols and slurs.
- Content infringing intellectual property, publicity, or privacy rights — works, characters, logos, packaging, trade dress, or brand assets you do not own or have no license to use, including unauthorized use of a real person's likeness.
- Content that is unlawful, fraudulent, deceptive, or otherwise violates any applicable law or regulation, including fraud, scams, and deceptive advertising claims.
- Content intended to generate malware, phishing material, or spam, or to facilitate any illegal activity.
You also agree not to:
- Upload content you do not have the right to use.
- Use the service, or outputs from it, to train, fine-tune, or evaluate a competing AI model.
- Scrape or bulk-extract the service at scale, or access it other than through the interface and publicly documented API we provide, including automated access outside those channels.
- Present AI-generated outputs as the work or professional advice of a licensed professional — including medical, legal, financial, or psychological advice — or otherwise impersonate a professional.
- Interfere with, reverse engineer, overload, or disrupt the service.
- Attempt to bypass security, rate limits, billing, credits, access controls, or our content moderation systems.
- Resell, sublicense, or lease access to the service without our written permission.
Content moderation
Free-text prompts submitted to the service are screened against our content policies before they reach a generation model, and the third-party models that power the service apply their own safety filters and may independently refuse a request. Blocked prompts are refused in the product and do not consume credits. Reported and flagged accounts are additionally reviewed by our team, who may examine the prompts, uploads, and outputs associated with an account in order to enforce these terms.
Moderation is a safeguard, not a guarantee. You remain responsible for reviewing every output before you publish it and for complying with the rules of the platforms you publish to.
Reporting violations
To report content or behavior that violates these terms, email support@imagesart.ai with the subject line AUP report, or use the support channel in the product. Include a link to the content or account, what you believe was violated, and how we can reach you. We acknowledge reports within 3 business days; critical reports (child safety, terrorism, non-consensual intimate imagery, credible threats) are escalated immediately. Reporter identity is protected.
Enforcement
Depending on the severity, frequency, and intent of a violation, we may issue a warning, remove content, restrict features, suspend or permanently terminate the account, and refer conduct that appears criminal to law enforcement. Enforcement does not entitle you to a refund of unused credits or of the remainder of a subscription period, except where applicable law requires one.
User content, AI outputs, and ownership
You retain the rights you hold in the prompts and media you submit, and in the outputs generated for you, subject to these terms and applicable law. You grant us the rights needed to host, process, transmit, store, and display that content in order to operate the service and deliver the features you request.
We do not use your prompts, uploaded media, or generated outputs to train our own foundation models, and we do not sell this content. We may use aggregated or de-identified usage data that does not identify you to operate, secure, and improve the service.
You are responsible for reviewing outputs before use. AI-generated content may be inaccurate, incomplete, or unsuitable for your intended purpose, and you must ensure you hold the necessary rights and permissions for anything you upload.
Copyright and takedowns
We respect intellectual property rights. If you believe content on the service infringes your copyright, send a notice to support@imagesart.ai identifying the work, the material you claim is infringing and its location, your contact details, and a statement that you have a good-faith belief the use is unauthorized. We may remove infringing content and terminate repeat infringers.
Plans, credits, and billing
Current plans, prices, included credits, and limits are shown on our pricing page and at checkout, which are authoritative. As of the effective date above:
- Free — $0. 5 image credits per day, granted on sign-in.
- Starter — $9.90 per month, or $71.00 per year. 300 image credits per month.
- Pro — $19.90 per month, or $143.00 per year. 900 image credits per month.
Paid plans also include unlimited image-to-text usage. Free accounts additionally receive a one-time allowance of 10 image-to-text credits.
Credit packs. In addition to subscriptions, you may buy one-time credit packs: 120 credits for $6.90, or 320 credits for $16.90. Credit packs are one-time purchases with no automatic renewal, and each pack expires 30 days after purchase.
How credits are consumed and expire.
- Free daily credits expire at the end of the same UTC day and do not accumulate.
- Subscription credits are reset at the start of each billing period and do not roll over to the next period.
- Purchased credit packs are tracked separately from your plan allowance and are not affected by changing or cancelling your subscription — each pack simply runs to its own 30-day expiry.
- When you generate, we consume purchased pack credits first (earliest expiry first), and only then your plan allowance.
Free trial. Annual plans may include a 3-day free trial that grants a limited sample allowance (currently 50 image credits on Starter and 120 on Pro). Unless you cancel before the trial ends, the trial converts automatically into a paid annual subscription and the annual fee is charged. You may cancel at any time during the trial at no cost.
Automatic renewal — payment authorization. By purchasing a subscription you authorize us and our payment provider to charge your payment method on a recurring basis — monthly for monthly plans, annually for annual plans — at the then-current price, automatically at the start of each new billing period, until you cancel. We will send a reminder before an annual subscription renews. Prices shown are exclusive of taxes; applicable sales tax, VAT, or GST is calculated and added at checkout. Failure to pay may result in limited access, suspension, or termination.
Payment processing. Payments are processed by Waffo Pancake, which acts as merchant of record for your purchase. Payment card data is collected and processed by Waffo Pancake in accordance with PCI-DSS; we do not receive or store complete payment card details on our servers. Your card statement will show the descriptor configured by Waffo Pancake for this service.
Cancellation
You can cancel a subscription at any time, in either of these ways:
- Online, in your account — go to Settings → Billing at https://imagesart.ai/app/settings/billing and use the Cancel subscription control, or open the customer portal from the same page.
- By email — write to support@imagesart.ai from the address on your account and ask us to cancel.
Cancellation takes effect immediately in the sense that no further renewal charges are made. Your paid features remain available until the end of the billing period you have already paid for, after which the account reverts to the Free plan. Cancelling a subscription does not automatically refund the current period, and does not affect credit packs you have already purchased.
Refunds
Because ImagesArt.ai provides digital services and AI generation resources that may be consumed immediately, purchases are generally final once credits, subscriptions, or paid features have been delivered or used.
- Subscriptions. Subscriptions renew automatically unless cancelled before the renewal date. Cancelling stops future renewals but does not automatically refund the current billing period. We may consider refund requests for accidental renewals or billing errors when the request is submitted promptly and the subscription has not been materially used after renewal.
- Credits and one-time purchases. Credit packs and other one-time digital purchases are generally non-refundable after credits are delivered, consumed, expired, or associated with generated outputs. If credits were not delivered due to a technical or billing error, contact us so we can investigate and either restore the credits or issue an appropriate refund.
- Failed generations. AI generation may fail due to provider errors, safety checks, unavailable upstream services, invalid inputs, or temporary infrastructure issues. When a failed generation consumes credits incorrectly, we may restore credits or provide another appropriate remedy. Refunds are not guaranteed for dissatisfaction with creative results, subjective quality, prompt choices, or outputs that require iteration, unless required by applicable law.
- Duplicate charges. If you were charged more than once for the same purchase, contact us and we will refund the duplicate charge.
How to request a refund. Email support@imagesart.ai with the email address on your account, the order or payment identifier, the date and amount of the charge, and a brief explanation. We may ask for additional information to verify the request and prevent fraud.
Abuse and chargebacks. We may deny refund requests that appear fraudulent, abusive, inconsistent with this policy, or related to violations of these terms. Unauthorized chargebacks may result in account suspension or loss of access to paid features.
Your legal rights. Nothing in this section limits any refund, cancellation, or consumer right that cannot be waived under applicable law, including any statutory right of withdrawal available to consumers in the EU and UK.
Billing disputes
If you believe you have been charged incorrectly, email support@imagesart.ai before initiating a chargeback. We aim to acknowledge billing enquiries within 2 business days and to resolve them within 5 business days, and we will work with our payment provider where a charge needs to be traced or reversed.
Third-party services
The service integrates with third-party providers for payments, hosting, storage, authentication, analytics, and email, and with the AI model providers listed above. Your use of those services may be subject to their own terms and policies.
Intellectual property
The service, software, branding, design, and related materials are owned by us or our licensors. Except as expressly allowed, you may not copy, modify, distribute, sell, or lease any part of the service. No use of our logo or other artwork is permitted for linking without a trademark licence agreement, and you may not frame our pages in a way that alters their visual presentation.
Suspension, termination, and account deletion
We may suspend or terminate access if you violate these terms, create risk for the service or other users, fail to pay fees, or use the service in a way that may expose us to liability. Where we terminate a paid account without cause, we will refund the unused portion of the current subscription period on a pro-rata basis.
You may stop using the service at any time, and you may delete your account from Settings in the product or by emailing support@imagesart.ai. Note that for 30 days after deletion, a new account registered with the same email address is not granted free credits — this protects the free tier from abuse. Certain sections of these terms survive termination where their nature requires it.
Data and privacy
Our Privacy Policy explains what we collect and how we use it, and forms part of these terms. Payment card data is handled by Waffo Pancake under PCI-DSS as described above. Account data is retained for as long as needed to provide the service and to meet legal, accounting, security, and fraud-prevention obligations, and is deleted or de-identified thereafter.
Disclaimers
The service is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, secure, or free of inaccuracies, or that outputs will meet your requirements.
AI outputs are generated automatically and may be inaccurate, incomplete, biased, or misleading. They are not professional advice and must not be relied on for legal, medical, financial, safety-critical, or similar purposes. You are solely responsible for reviewing and verifying any output before you use or publish it.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities.
To the maximum extent permitted by law, our total liability for any claim relating to the service will not exceed the greater of the amounts you paid to us for the service in the twelve months before the event giving rise to the claim, or USD 100.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above may not apply to you, and nothing here limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law.
Indemnification
You agree to indemnify and hold harmless ImagesArt.ai and its affiliates, officers, and employees from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your content, your use of the service, or your violation of these terms or applicable law.
Governing law and disputes
These terms are governed by the laws of the People's Republic of China (for these purposes excluding Hong Kong, Macau, and Taiwan), without regard to its conflict-of-laws rules. You agree that any dispute will be resolved exclusively in the competent people's courts of Nanjing, Jiangsu Province, China, except where applicable law gives you the right to bring proceedings elsewhere. Before starting formal proceedings, please contact us at support@imagesart.ai so we can try to resolve the matter directly. Nothing here removes mandatory consumer protections available to you under local law.
General
These terms, together with the Privacy Policy, form the entire agreement between you and us regarding the service. If any provision is found unenforceable, the remaining provisions stay in effect. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce any right is not a waiver of it.
Changes to these terms
We may update these terms from time to time and will update the effective date above. Continued use of the service after changes become effective means you accept the updated terms.
